1. SERVICE DESCRIPTION

1.1 G-SPEED provides Fiber Optic Internet Services including:

• Residential Fiber Internet

• Business Internet

• Dedicated Internet Access (DIA) / Lease Line

• Enterprise Connectivity Solutions

1.2 Service speed and performance are subject to network conditions, technical limitations, and force majeure events.

2. SERVICE INSTALLATION

2.1 Installation shall be scheduled upon approval of application and payment of required fees.

2.2 Installation fees are non-refundable once service is activated.

2.3 Any additional materials required beyond standard installation (extra fiber drop, poles, civil works, special routing) shall be charged separately.

2.4 The Company reserves the right to decline installation if:

• Location is outside serviceable area

• Unsafe environment

• Technical limitations exist

3. CONTRACT TERM

3.1 Standard contract term is 12 months unless otherwise agreed in writing.

3.2 Pre-termination before contract expiration shall result in:

• Payment of remaining months OR

• Pre-termination fee equivalent to 50% of remaining contract value (whichever is applicable under signed agreement).

4. BILLING AND PAYMENT

4.1 Billing cycle begins upon service activation.

4.2 Payment due date shall be indicated in the billing statement.

4.3 Late payments shall incur:

• Late payment fee of ___% per month

• Possible service disconnection after ___ days of non-payment.

4.4 Reconnection fee shall apply for accounts disconnected due to non-payment.

5. SERVICE AVAILABILITY & SLA

5.1 G-SPEED aims to provide reliable service with high uptime availability.

5.2 Scheduled maintenance may occur with prior notice.

5.3 Emergency outages may occur due to:

• Fiber cuts

• Power interruptions

• Natural disasters

• Third-party damages

• Government actions

5.4 For Dedicated/Lease Line clients, Service Level Agreement (SLA) shall be governed by separate signed SLA document.

6. CUSTOMER RESPONSIBILITIES

6.1 Subscriber agrees to:

• Protect installed equipment

• Provide stable power supply

• Not tamper, relocate, or modify equipment

• Allow access to technicians for maintenance

6.2 Subscriber shall be liable for damages caused by:

• Negligence

• Unauthorized relocation

• Physical damage to equipment

7. ACCEPTABLE USE POLICY (AUP)

7.1 The service shall not be used for:

• Illegal activities

• Hacking, spamming, cyber attacks

• Distribution of illegal content

• Reselling service without written authorization

7.2 Violation may result in:

• Immediate suspension

• Permanent disconnection

• Legal action

8. EQUIPMENT OWNERSHIP

8.1 ONU/Modem remains property of G-SPEED unless otherwise stated.

8.2 Equipment must be returned in good condition upon service termination.

8.3 Damaged or unreturned equipment shall be charged to the Subscriber.

9. SERVICE TRANSFER / RELOCATION

9.1 Service relocation is subject to:

• Technical feasibility

• Relocation fee

9.2 Contract term remains in effect after relocation.

10. DATA PRIVACY

10.1 G-SPEED complies with applicable Philippine laws including:

• Data Privacy Act of 2012

10.2 Client information shall be used only for:

• Account management

• Billing

• Technical support

• Legal compliance

11. LIMITATION OF LIABILITY

11.1 G-SPEED shall not be liable for:

• Indirect or consequential damages

• Loss of business income

• Loss of data

11.2 Maximum liability shall not exceed one (1) month service fee.

12. FORCE MAJEURE

The Company shall not be held responsible for delays or failure to perform due to:

• Natural disasters

• War

• Government orders

• Power grid failure

• Fiber cuts caused by third parties

13. AMENDMENTS

G-SPEED reserves the right to modify these Terms and Conditions with prior notice to subscribers.

14. GOVERNING LAW

This agreement shall be governed by the laws of the Republic of the Philippines.

Any disputes shall be filed in the proper courts of Davao del Sur or Davao Occidental.
